By participating, entrants agree to be bound by these Official Rules and the interpretations and decisions of Eastern Mountain Sports, which are binding and final on matters relating to the Official Rules and this Sweepstakes. Sweepstakes is subject to all applicable federal, state, and local laws.

HOW TO ENTER: You must enter as explained below between August 12 and September 1, 2009 (the "Entry Period"). Entries received before or after the Entry Period will not be eligible.

ONLINE ENTRY: Visit emsclimb.com between 1am EDT on August 12, 2009, and 11:59 pm EDT on September 1, 2009; click on the Eastern Mountain Sports Win School for Life Sweepstakes icon; and complete the online entry form.

IN-STORE ENTRY: Visit any Eastern Mountain Sports store during normal store hours during the Entry Period, complete an entry form available in the store, and deposit the completed entry form in the Win School for Life Sweepstakes entries box.

MAIL-IN ENTRY: Send a 3 x 5 inch postcard (postage paid) with your name, mailing address, telephone number, date of birth, email address, and the words "Eastern Mountain Sports Win School for Life Sweepstakes" to Eastern Mountain Sports Sweepstakes, 1 Vose Farm Rd., Peterborough, NH 03458. Postcard entries must be postmarked no earlier than August 12, 2009, and no later than September 1, 2009.

Limit one (1) entry per individual and/or email address for the duration of the Entry Period. Multiple entries received from any email address after the first entry received from that email address will be void.

Entries generated by script, macro, or other automated means are void.

All entries become the property of Eastern Mountain Sports and will not be acknowledged or returned.

DRAWING: A potential winner will be selected by random drawing from all eligible entries on or about September 30, 2009.

Odds of winning depend on the number of eligible entries received.

NOTICE TO WINNERS: Eastern Mountain Sports will notify the potential winner by telephone or email if the potential winner is not present at the time of the drawing. If a potential winner declines, or does not fulfill the requirements for the award of the prize, an alternate potential winner will be selected by random drawing.

PRIZE: The prizewinner will receive a Lifetime Eastern Mountain Sports School Pass for one-day group lessons conducted by Eastern Mountain Sports Climbing School, Kayak School, or Trek School ("Eastern Mountain Sports Schools"). The Lifetime Pass entitles the winner to participate in one one-day group lesson at one of the Eastern Mountain Sports Schools once every six months during the life of the prizewinner.

APPROXIMATE RETAIL VALUE OF PRIZE IS $4500.00. Actual value will depend on the prizewinner's use of the Eastern Mountain Sports School Pass.
Lifetime Pass privileges are subject to the winner's compliance with Eastern Mountain Sports School policies, procedures, and rules. Availability of lessons will be subject to regular limitations on the permissible number of participants and advance reservation rules. The winner must sign a release and assumption of risk agreement and other documentation in connection with each activity as required by Eastern Mountain Sports. The winner may not substitute, assign, or transfer prize or redeem prize for cash. The winner is responsible for all taxes in connection with his/her prize. Eastern Mountain Sports will collect sales tax from the prizewinner for lessons as required by law. Eastern Mountain Sports reserves the right to substitute the prize with a prize of equal or greater value if the advertised prize becomes unavailable.

USE OF INFORMATION: Eastern Mountain Sports will use data about entrants obtained in connection with the entry into the Sweepstakes for the administration of the Sweepstakes and otherwise in accordance with Eastern Mountain Sports' privacy policy posted on the ems.com website. By submitting an entry, entrant agrees to such use of personal data.

GENERAL CONDITIONS: Releasees (as defined below) are not responsible for lost, late, incomplete, stolen, misdirected,undelivered, garbled, or illegible entries; failures or difficulties, or other errors of any kind, whether human, mechanical, electronic, or network; or the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. Persons who tamper with or abuse any aspect of the Sweepstakes, as solely determined by Eastern Mountain Sports, will be disqualified. Should any portion of the Sweepstakes be, in Eastern Mountain Sports' sole opinion, compromised by unauthorized human intervention or other causes, which, in the sole opinion of Eastern Mountain Sports, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Eastern Mountain Sports reserves the right at its sole discretion to suspend, modify, or terminate the Sweepstakes and select the winner from all eligible, non suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Eastern Mountain Sports.

Entrants, by participating, agree that Eastern Mountain Sports and its parents, affiliates, subsidiaries, advertising and promotional agencies, and all their respective officers, directors, employees, representatives, and agents (collectively, the "Releasees") will have no liability whatsoever for, and shall be held harmless by entrants against, any injuries, losses, or damages of any kind, including death, to persons or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of the prize or participation in this Sweepstakes.

Each winner, by acceptance of the prize, except where legally prohibited, grants permission for Eastern Mountain Sports and its designees to use his/her name, address (city and state), photograph, voice, and/or other likeness and prize information for advertising, trade, and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, in perpetuity, without notice or review or approval.

Eastern Mountain Sports may require the potential winner to sign separate written agreements confirming the agreements, releases, and permissions described above. In addition, the winner agrees to sign releases, assumption of risk, and other agreements and documents required by Eastern Mountain Sports.
